General Terms and Conditions (GTC)

of Worldalpin Service GmbH for the platform worldalpin.com

1. Scope
These General Terms and Conditions (GTC) apply to all contracts and business relationships between Worldalpin Service GmbH ("Worldalpin") and users of the worldalpin.com platform, comprising the areas Yetizone (job portal) and Trackzone (marketplace for used machinery and equipment).
Deviating, conflicting, or supplementary terms and conditions of users shall not become part of the contract unless Worldalpin explicitly agrees to them in writing.

3. Services Provided by Worldalpin
Worldalpin offers the following services via worldalpin.com:
- Yetizone: Publication of job advertisements, employer branding, access to candidate databases.
- Trackzone: Advertisement of used machinery and equipment, facilitation of sales and purchase contracts.
Worldalpin merely provides the technical platform. Contracts regarding the advertised positions or the purchase of equipment are concluded exclusively between the respective users.

4. Contract Conclusion and Registration
The use of certain areas requires registration. Users must provide complete and truthful information.
By submitting a registration or booking a paid service, users submit a binding offer to conclude a contract. Worldalpin may accept this offer by sending a confirmation email.

5. Prices and Payment Terms
The use of worldalpin.com may include both free and paid services.
The applicable prices are based on the price list valid at the time of booking or an individual offer.
Invoices are payable within 14 days without deduction.

6. Obligations of Users
- Users may not publish unlawful, offensive, or misleading content.
- Advertisements and listings must be truthful.
- Users are obligated to keep their access data confidential.
Worldalpin reserves the right to delete content and block user accounts in case of violations.

7. Warranty and Liability
Worldalpin endeavors to ensure constant availability and error-free operation of the platform but does not guarantee it.

Worldalpin is only liable for damages caused by intentional or grossly negligent breaches of duty. Liability for lost profits or indirect damages is excluded to the extent permitted by law.

8. Third-party Content
Advertisements, job postings, and other third-party content are not reviewed by Worldalpin for legality, accuracy, or completeness. Worldalpin assumes no liability for such content.

9. Contract Duration and Termination
Contracts for paid services are concluded for the agreed duration.
Ordinary termination before the expiration of the contract term is excluded unless otherwise agreed. The right to extraordinary termination remains unaffected.

10. Data Protection
Information on the processing of personal data can be found in the Privacy Policy on worldalpin.com.

11. Changes to the GTC
Worldalpin reserves the right to change these GTC at any time. Changes will be communicated to the user via email or on the platform.
If the user does not object within 14 days, the changes are deemed accepted.

12. Final Provisions
- Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
- The exclusive place of jurisdiction for all disputes arising out of or in connection with these GTC is 9020 Klagenfurt, provided the user is an entrepreneur.
- Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.

13. Advertising Partners and Advertisements
(1) Worldalpin offers companies and service providers the opportunity to book advertising space on worldalpin.com (e.g., banner ads, sponsored posts, job advertisements, product placements).
(2) Advertising content is provided by the advertising partner. Worldalpin reserves the right to review and reject or remove advertising content if it violates legal regulations, official orders, third-party rights, these GTC, or is otherwise unreasonable.
(3) The advertising partner is solely responsible for the legality and accuracy of their advertising materials and indemnifies Worldalpin against any claims by third parties arising in connection with the publication of advertisements.
(4) Type, scope, placement, and duration of the advertising shall be determined by individual agreement between Worldalpin and the advertising partner. There is no entitlement to a specific placement or permanent publication unless expressly agreed in writing.
(5) Compensation and payment terms for advertising services are based on the respective contractual agreement or the price list.
(6) Advertising that resembles editorial content (so-called native advertising or sponsored content) will be clearly labeled as advertising.
